Pico Creator Program Terms of Service

Overview

1. Eligibility
To be eligible for the revenue share program, you must:
• Be the creator of a remix-able Pico app
• When requested during the first payout, provide a valid PayPal account to receive payouts

2. Payout Details
• Payouts are calculated based on 30% of subscription fees paid by remixed app users in their first 12 months as paying customers. This does not include one-time purchases or other fees. Fees paid by users subscribed to custom enterprise pricing plans, defined as any pricing structure or plan whose cost is not explicitly and publicly listed on the Pico pricing page, are expressly excluded from the calculation of subscription fees.
• Payouts are made monthly on the 10th of each month. You will receive payment for applicable subscriber fees collected in the prior month. For example, on October 10th, you will receive payout for fees collected from applicable subscribers in September.
• There is no minimum accumulated balance to receive payouts.
• Only the creator of the first remixed app that leads to a user's subscription is eligible for payout for that user. If a user remixes multiple apps before subscribing, only the creator of the first app will receive revenue share.
• If a subscriber gets a refund, or issues a chargeback, the corresponding payouts will be deducted from future balances.

3. Payment Method
• Payouts will be sent to your verified PayPal account on file. Prior to your first payout, you will be ask to provide a valid PayPal email address to enroll in the revenue share program.
• It is your responsibility to ensure your PayPal account information is up to date. WhimsyWorks is not responsible for incorrect or outdated payment information resulting in non-payment.

4. Termination
• WhimsyWorks, Inc. reserves the right to suspend or terminate accounts violating policies from the revenue share program without notice.
• WhimsyWorks may terminate or modify the revenue share terms at any time. If the program is discontinued, any accumulated unpaid balances will be paid out.

5. Liability
• WhimsyWorks provides this revenue share program as-is and makes no guarantees regarding payment accuracy. You agree not to hold WhimsyWorks liable for any errors, omissions, or issues related to this program.
